Terms

We need to get this bit out of the way…

The terms and conditions are applicable to the supply of products made by the Seller, hereafter referred to as Gillies & Mackay Ltd, to the Buyer. The Seller means Gillies & Mackay Ltd, East Inchmichael, Errol, Perthshire, PH2 7SP and the company’s website,

www.gilliesandmackay.com. The Buyer shall mean the person(s), firm or company seeking to purchase the goods from the Seller.

Ok Sheddie, now the official bit is over, here are the things you need to know:

Levelling & Access

PLEASE NOTE: Full explanations of everything involved with preparation of your site can be found on our Buyer’s Prep Guides available on our website and in the Site Access Form you are required to complete on order. If you are buying from us we strongly recommend reading the relevant guide and forms .This will make everything much easier for everyone involved.

Before we deliver your order, it is important that you ensure your site is level and square. For Sheds, Radiata Garden Rooms and Workshops up to 16′ x 10′ we advise a slabbed base – if you need help finding someone to sort this for you, please get in touch.

On delivery day, your garden or site will become a construction site from when our deliverers arrive until their departure. Strict safety protocols will be in place. You must stay clear of the site and remain indoors for your own safety and to avoid accident or injury. Before the deliverers leave your site for the final time they will give you the all clear where you can then get full access again to your site and new Gillies & Mackay building.

Access to your site must be clear and unobstructed when we arrive and prices on our list allow for carrying of panels up to a maximum of 30 metres, due to the size of the panels and to comply with Health and Safety legislation. If access is not clear or the site not level, based on the information you provided on order, an extra labour charge will be levied at a rate of £15.00 per 15 minutes of labour. You will be notified of these charges.

It is not always convenient and is not good practice to carry buildings through garages, over walls, or over next door’s garden (unless we have express permission from them)!

If access is not clear or the site not level, on delivery day, whereby you have failed to communicate with us on the lead up to your delivery – we will have to leave the building for you to assemble yourself. If you then require us to return and erect the building for you, an extra charge will be levied at a rate of £15.00 per 15 minutes of labour and £50.00 for extra vehicle costs.

If you have a problem with your site, or have any doubts about levelling, please let us know well in advance and we’ll do what we can to help. 

Photography and Videography of Works

We reserve the right to photograph, video and publish pictures of our buildings publicly, pre/post and during the delivery and assembly. In doing so, we will ensure customer addresses, location and names will not be identifiable unless consent from the customer is given.

Site for Delivery

Please ensure that there is someone available to show us where you would like your timber building positioned (we don’t want to get it wrong!), if no-one can be available, please provide us with a site plan ahead of the delivery date.

If we don’t receive a site plan and your preferred site is not absolutely evident, we will have to leave the building for you to assemble yourself, and if we need to return to assemble the building for you, an extra charge will be levied at a minimum of £50.00 to cover vehicle costs.

Payment

Full payment must be received one week/seven days prior to the agreed delivery date; however, a 20% deposit is required for Sheds and 30% for Radiata Garden Rooms, Blackstone Garden Rooms, Workshops or Garages. Deposits are non-refundable should you fail to notify us of cancellation of your order 12 weeks prior to your estimated delivery date.

If you would like to pay by card, please arrange this by calling our office, sending by BACS, or by cheque. Payment details will be sent to you on order. We accept Mastercard, Visa and Maestro. We do not accept American Express – sorry! 

Cheques should be made payable to Gillies & Mackay Ltd. All prices are quoted in Pounds Sterling and inclusive of VAT at the prevailing rate. Any order that remains unpaid seven days before the scheduled delivery will be cancelled and the slot reallocated.

Title & Risk

You will not take ownership of the goods until we have been paid the whole and any outstanding payments are settled.  You agree that prior to the payment of the whole price of the goods, we (or an agent appointed by us)  may at any time enter your premises or premises under your control or to which you have right of access, for the purpose of inspection, repossession and removal of goods, and that prior to full payment that you will keep the goods in good and substantial repair and condition and separate and identifiable for the aforementioned purposes. 

Nothing herein shall constitute you our agent for the purposes of sub-sale. Notwithstanding that property in the Goods shall not pass to the Buyer save as provided above, the Goods shall be at the risk of the Buyer when the Goods are delivered or when a Buyer is notified that they are available for collection. Notwithstanding the preceding provisions of this clause, the Seller may at his sole discretion, and at any time by notice in writing to the Buyer, transfer the property in the Goods to him.

Planning Permission & Licensing of Drawings

1. Planning Application Service & Fee

Gillies & Mackay Ltd. (“the Seller”) offers a planning application service for a flat-rate fee of £696.00, which covers the preparation and submission of planning drawings and relevant documentation.

This service is only available when the Buyer also pays a refundable deposit of 20% for Sheds and 30% for orders of Radiata Garden Rooms, Blackstone Garden Rooms, Workshops or Garages, towards the full order value.

If planning permission is not granted, the deposit will be refunded in full.

2. Commitment to Purchase

The planning application service is provided with the understanding that, upon granting of planning permission, the Buyer will proceed with the purchase of the building from the Seller.

3. Non-Completion of Order & Licence Fee

If the Buyer does not proceed with a Gillies & Mackay Ltd. order after planning permission has been granted, the Buyer will be liable for a licence fee for the use of the provided drawings.

This licence fee will be calculated at 12.5% of the original full order value agreed at the time of the planning application.

The Buyer must settle this fee within 14 days of notification, failing which the Seller reserves the right to pursue legal action for unauthorised use of intellectual property.

4. Use of Drawings and Plans

All planning drawings and plans provided by the Seller remain the intellectual property of Gillies & Mackay Ltd.

The Buyer must not use, reproduce, or share the drawings with third parties without written consent from the Seller.

If planning permission is granted but the Buyer does not proceed with a Gillies & Mackay Ltd. order, any subsequent use of the drawings by the Buyer or a third party constitutes unauthorised use and is subject to the applicable licence fee.

Delivery Dates

Any delivery date shall be considered as indicative only, although it is our policy to endeavour to fulfil all orders within 150 days. That being said, we cannot be held responsible for delays in delivery caused by any other third party.

Alterations to Order

On order, you are allocated a date and a specific amount of time for your delivery based on the type and design of building and the ease of your Site Access. Any change/alteration requests will be reviewed by Gillies & Mackay. You may risk losing your scheduled delivery date, given on order, and be rescheduled to our current lead time to allow for sufficient time for the delivery and assembly of your building. Alteration requests can be sent by email to info@gilliesandmackay.com. We reserve the right to refuse alteration requests.

Acceptance

Unless otherwise specified, all items should be signed for on delivery or collection.

It is important that you, the buyer, inspect the goods within 48 hrs of receipt and after that time we will consider the goods as accepted.

Cancellations

Cancellations are only accepted by emailing us and should be made no later than 12 weeks prior to the estimated date of delivery. If cancellation is not made within this period, then the order will be considered valid and you will remain liable for the full payment.

Planning Laws

Certain buildings may be subject to planning permission or building control. While we are happy to provide you with diagrams or build-sizes of the various types of building, it is entirely your responsibility to familiarise yourself with the planning regulations in your local authority area and to complete the necessary paperwork if required to do so. We will take no responsibility for the erection of buildings where the correct permissions have not been sought and which may later be subject to a removal order by the relevant planning department. We are happy to provide drawings – drawings and revision of drawings, have a minimum charge of £240.00. If you require us to act as your agent in a planning application, the relevant planning fee will be applied. Please ask for details.

Law

These terms and conditions are governed and shall be interpreted in accordance with the Law of Scotland.

We reserve the right to decline an order and to alter the designs and/or specifications without prior notice. Such changes would be made in order to upgrade and improve existing designs. The designs of the buildings and of any publications are copyright Gillies & Mackay Ltd.

Refer a Friend Scheme

Friend – To claim your £50 cashback, you must state the name and email address of the friend that referred you. Only one discount offer can be used per building. Cashback is honoured on delivery of your building.

Existing G&M Customer – Your £50 cashback will be paid to you once your friends building has been paid in full and delivered successfully. You can refer up to 3 friends maximum.
